Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and the operator of Fit Booster (“we”, “us”, or “our”). They govern your access to and use of the Fit Booster mobile application and related backend services (together, the “Service”). By creating an account, downloading the app, or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Fit Booster is a fitness tracking application for iOS and Android that lets you log workouts, track progress, create training templates, and receive automated progression recommendations based on your own training history. Core features are available free of charge; advanced features are available through a paid subscription as described in section 3.

2. Your Account

2.1 Eligibility

You must be at least 9 years old to use the Service. By creating an account you represent that you meet this requirement.

2.2 Sign-in by one-time code

The Service does not use passwords. To sign in you provide your email address and we send you a six-digit one-time code. You are responsible for keeping access to the email inbox you use. Sharing your sign-in code or your device’s authenticated session with anyone else is at your own risk.

2.3 Your data in your account

You are responsible for the accuracy of the profile and training data you enter. You can edit most fields in the app and can delete your account at any time via Profile → Delete Account.

3. Subscriptions

3.1 Plans and pricing

Fit Booster offers auto-renewable subscriptions under the “Fit Booster Pro” entitlement:

  • Monthly - billed every month (currently USD 4.99 or the local equivalent shown at purchase).
  • Yearly - billed every 12 months (currently USD 44.99 or the local equivalent shown at purchase).

The price, billing period, and any introductory offer are shown on the subscription screen inside the app before you confirm a purchase. Prices are set by us and may differ by country or storefront. Apple may adjust local prices in response to currency or tax changes in accordance with its policies.

3.2 14-day free trial

Eligible new subscribers may be offered a 14-day free trial of Fit Booster Pro. You will have full access to Pro features during the trial. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the price of the selected plan. Apple allows only one free trial per subscription group per Apple ID; we cannot override that limit.

3.3 Auto-renewal

Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan. You can review and manage your subscriptions, and turn off auto-renewal, in your Apple ID account settings after purchase.

3.4 Cancellation

You can cancel a subscription at any time by going to Settings → [your name] → Subscriptions on your Apple device, or by visiting apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period; you keep Pro access until that date. Deleting your Fit Booster account does not cancel an active App Store subscription; you must cancel it separately in Apple’s settings.

3.5 Refunds

All payments are processed by Apple. Refund requests are handled by Apple under its own policies. You can request a refund at reportaproblem.apple.com. We cannot issue refunds directly.

3.6 Changes to plans and prices

We may add, remove, rename, or change the price of subscription plans. Changes apply to new purchases, and to renewals after any notice period required by Apple or applicable law. Your continued use of the Service after a change takes effect constitutes acceptance of the change.

4. Acceptable Use

You agree not to:

  • Use the Service in violation of any law or third-party right.
  • Reverse engineer, decompile, disassemble, or attempt to bypass the technical protections of the Service, except to the extent applicable law expressly permits.
  • Use bots, scrapers, or automated means to access or extract data from the Service.
  • Submit content that is unlawful, abusive, harassing, or that infringes the rights of others.
  • Attempt to access other users’ data or to impersonate another person.

5. Your Content

Content you create in the Service - workout logs, templates, custom exercises, notes, and optional deletion feedback - remains yours. You grant us a limited, worldwide, royalty-free license to host, store, and process this content solely to operate and improve the Service. We do not claim ownership of your content.

6. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our trademarks or the Service except the limited right to use the app as intended.

7. Health Disclaimer

Fit Booster is a fitness tracking and training log tool. It is not medical advice, diagnosis, or treatment. Exercise involves inherent risks including serious injury. Consult a qualified healthcare professional before starting, changing, or continuing any training programme, especially if you have any medical condition. You are solely responsible for your health, training decisions, and safety while using the Service.

8. Third-Party Services

The Service relies on third-party providers for essential functions, including Apple (app distribution and payments), RevenueCat (subscription management), MongoDB Atlas (data storage), DigitalOcean (backend hosting), and Resend (transactional email delivery). Your use of these providers’ services is subject to their own terms. Details of what data they process are described in our Privacy Policy at fitbooster.app/privacy.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will meet your fitness goals.

10. Limitation of Liability

To the maximum extent permitted by applicable law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, whether arising from contract, tort, or otherwise. Our total aggregate liability for any claim arising from or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim or (b) USD 50.

11. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, created risk of legal exposure for us, or abused the Service. You may stop using the Service at any time and can permanently delete your account from within the app. Termination does not entitle you to a refund unless required by applicable law or Apple’s refund policies.

12. Apple-Specific Terms (EULA)

The iOS version of Fit Booster is licensed to you by us, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for the Service or for any claims relating to the Service (including product liability, consumer protection, or intellectual property). To the extent these Terms conflict with Apple’s Licensed Application End User License Agreement, Apple’s terms prevail with respect to the iOS app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date and, where appropriate, notify you in the app. If you continue to use the Service after a change becomes effective, you are deemed to accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of that jurisdiction, unless a mandatory consumer protection law of your country of residence requires a different forum or law.
